Seagraves Teacher Charged With Having Sex With A Student

The teacher accused of a sexual relationship with a 9th grader at
Seagraves Junior High is behind bars, charged with three felony
counts. 31-year-old Candra Dee Payton surrendered herself to the
Gaines County Jail Thursday afternoon, just hours after a grand jury
indicted her on three counts in connection with the alleged
relationship.
When the investigation first started we were told merely an "improper
relationship" was under investigation, but now Candra Payton stands
indicted on three separate charges.
A first degree felony - sexual assault indecency with a child.
Second degree felony - improper relationship between an educator and a
student and
A third degree felony - tampering with or fabricating physical
evidence.
It's that second charge that gives us insight into the alleged crime.
Texas law states:
"An employee of a public or private primary secondary school commits
an offense if the employee engages in sexual contact, sexual
intercourse or deviate sexual intercourse with a person who is
enrolled in a public or private primary or secondary school."
This law was passed by the 78th legislature back in 2003, so it's a
fairly new law. If convicted, Payton could face anywhere from two
years to life in prison and $30,000 in fines. Her bond has been set at
$600,000.
