Amy Lee Kelly, a former
Kentfield teacher, accepted a plea deal and could serve most of her
sentence at home. (IJ archive)A former Kentfield schoolteacher who had
a drunken sexual encounter with two Redwood High School teenagers last
year was sentenced Wednesday to nine months in county jail.
Amy Lee Kelly, 41, of Benicia
was ordered to surrender to the jail on July 17, but she might be
released shortly thereafter to serve her sentence under home
detention.
Kelly, who could have faced up
to three years in prison in the case, trembled uncontrollably during
final arguments before Judge Faye D'Opal.
Prosecutor Teresa Leon Varela
said Kelly's conduct has left the teens with years of emotional
trauma, but defense attorney Michael Semansky said Kelly has already
suffered considerable public humiliation and the loss of her teaching
credentials.
"Testosterone and alcohol are a
bad combination," Semansky said.
Kelly was charged last August
in connection with a gathering at the Corte Madera home of one of her
friends. Authorities said Kelly was heavily intoxicated and engaged in
sexual activity with two 15-year-old Redwood High School students who
were friends of the homeowner's 15-year-old daughter.
The daughter took pictures of
Kelly with the two boys, who were apparently intoxicated as well,
investigators said.
Semansky has previously
acknowledged that Kelly was intoxicated, saying she had been
struggling with an alcohol problem since getting divorced in recent
years.
Kelly was initially charged
with two counts of lewd acts upon a child and one count of unlawful
sexual intercourse, and could have faced more than four years in
prison on those charges.
In April, Kelly accepted a deal
with prosecutors and pleaded guilty to one felony count of oral
copulation of a person under 18 years old and one misdemeanor count of
battery.
In addition to the jail time,
Judge D'Opal sentenced Kelly to supervised probation for five years
and community service. Kelly is barred from consuming alcohol or drugs
during her probation and cannot visit with any minors except her own
children.
D'Opal also ordered Kelly to be
examined for sexually transmitted diseases and report any positive
results to the parents of the teens.
Kelly, who has two children,
taught for 11 years at Bacich Elementary School in Kentfield. She
resigned the job in June 2006, several months before the sexual
encounter.
